General
Pangaea Exploration LLC, a Florida limited liability company trading as “Panexplore” (“COMPANY,” “we,” “us,” or “our”), organizes and operates offshore sailing expeditions and voyages for paying crew members (“Crew”). These Terms & Conditions govern your relationship with us in connection with any booking, voyage, trip, or use of our website at www.panexplore.com (the “Site”). By making a booking or using the Site, you agree to be bound by these Terms & Conditions and our Privacy Policy, both of which may be updated from time to time. Where additional terms apply to specific trips, expeditions, voyages, products, or services offered through the Site, those terms will be brought to your attention and form part of your agreement with us.
References to “booking” mean any confirmed reservation of a place on a Panexplore trip. References to “voyage” or “trip” mean the sailing expedition or passage you have booked. References to “Crew” mean all paid participants, including you, travelling on a Panexplore voyage.
Booking, Deposits & Payments
By making a booking with Pangaea Exploration LLC, trading as Panexplore, you represent, warrant, and agree that:
- you have read these Terms & Conditions in full and agree to be legally bound by them;
- you consent to our collection and use of your personal data in accordance with our Privacy Policy, including, where applicable, the collection of special categories of personal data (such as health or medical information necessary for the safe delivery of your trip),
- you are at least 18 years of age and have the legal capacity to enter a binding contract under Florida law; and
- you accept full financial responsibility for all payments due in connection with the booking, whether made on your own behalf or on behalf of other participants included in the booking.
A non-refundable deposit is required to reserve your spot on any Pangaea Exploration LLC expedition. By submitting your deposit, you confirm that you have read and agree to these Terms & Conditions.
The remaining balance is due 90 days prior to the trip start date. Bookings made within 90 days of departure require full payment at the time of booking.
All payments must be made in US Dollars. We accept the payment methods listed on our Site at the time of booking. You are responsible for any bank or transfer fees associated with your payment.
Pricing
Pangaea Exploration LLC reserves the right to amend advertised prices at any time and to correct errors in the prices of advertised or confirmed trips prior to your booking being accepted. Once your booking has been confirmed in writing, the price of your trip is guaranteed and will not be subject to surcharge, except as required by applicable law.
From time to time, Pangaea Exploration LLC may offer discounts or promotional offers. Such offers apply to new bookings only and will not be applied retrospectively to existing confirmed bookings. A maximum of one discount or promotional offer may be applied to any single booking; offers may not be combined.
Cancellations & Refund Policy
If You Cancel Your Booking Before the Trip Start Date
If you decide to cancel your confirmed booking, you must notify us in writing by email, stating the reason for the cancellation. Your notice of cancellation will only take effect when it is received in writing and acknowledged by us; it will be effective from the date on which we receive it.
All deposits are non-refundable. Balances paid beyond the deposit are non-refundable within 90 days of the trip start date. Cancellations made more than 90 days before departure may receive a partial refund of amounts paid beyond the deposit, at Pangaea Exploration LLC’s discretion. If you are unable to attend your booked trip, you may transfer your deposit one (1) time to another available Pangaea Exploration LLC trip departing within 12 months of the original trip start date, subject to availability. Transfer requests must be submitted in writing to hello@panexplore.com prior to the original trip departure date. No further transfers or refunds will be issued after the one-time transfer has been used.
If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim applicable charges from your insurer. Pangaea Exploration LLC does not accept responsibility for any insurance claim or its outcome.
In the event of “Unavoidable and Extraordinary Circumstances” (as defined below) occurring before the trip start date, in the location where the trip is taking place, which will significantly affect the ability of the trip to proceed, you may be entitled to cancel your booking and receive a full refund of payments made to Pangaea Exploration LLC. We will not be liable to pay any additional compensation. You must be able to demonstrate at the time you wish to cancel that there is no reasonable possibility of the trip going ahead in order to rely on this provision.
Trip Cancellations or Material Modifications
If Pangaea Exploration LLC cancels a trip or makes a material modification to a trip (including, but not limited to, a significant change to itinerary, destination, or dates), you will be notified as soon as reasonably practicable. In such an event, you may decide not to board the yacht and choose either:
- A full refund of all amounts paid to Pangaea Exploration LLC for that trip; or
- A transfer of all amounts paid to another available Pangaea Exploration LLC trip, subject to availability.
Trip Delays
If you’ve already checked in on your trip and the Yacht is delayed beyond 72 consecutive hours for reasons within Pangaea Exploration LLC’s control, Pangaea Exploration LLC will issue a pro rata refund calculated against the daily voyage rate for the period of delay beyond 72 hours. If the total delay exceeds 50% of the planned passage duration, Crew may elect to cancel their booking and receive a full refund of all amounts paid directly to Pangaea Exploration LLC. This refund right is the Crew’s sole and exclusive remedy in respect of any such delay, and Pangaea Exploration LLC shall not be liable for any further loss or expense arising therefrom.
Pangaea Exploration LLC’s liability in the event of cancellation, delay or material modification is limited solely to a refund of amounts paid directly to Pangaea Exploration LLC. Pangaea Exploration LLC is not responsible for any incidental costs you may have incurred, including but not limited to airfare, accommodation, visas, or travel insurance.
Unavoidable & Extraordinary Circumstances
Very rarely, it may be necessary for us to change or cancel your trip due to “Unavoidable and Extraordinary Circumstances”. This section sets out your rights where we are compelled to act due to such events; it is distinct from the Force Majeure clause below, which governs our general liability for events outside our control. If this occurs, the cancellation terms will apply. If you wish to cancel your trip due to Unavoidable and Extraordinary Circumstances occurring at the place of destination or its immediate vicinity which will significantly affect the performance of the trip, you may be entitled to cancel without triggering the standard cancellation terms. In such circumstances, we shall provide a full refund of monies paid to Pangaea Exploration LLC, but we will not be liable to pay any additional compensation. You must be able to demonstrate at the time you wish to cancel that there is no reasonable possibility of the trip going ahead in order to rely on this provision.
For the purposes of this condition, “Unavoidable and Extraordinary Circumstances” means any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), piracy, civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination, natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the trip start location or take part in the trip itinerary, sea, ice and river conditions, the act of any government or other national or local authority including port or river authorities, industrial dispute, labor strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport, and all similar events outside our control.
Force Majeure
Pangaea Exploration LLC shall not be liable for any delay, modification, or cancellation of a voyage caused by events beyond our reasonable control, including but not limited to: natural disasters; acts of God; fire; flood; hurricane or other extreme weather; earthquake; pandemic or epidemic; government restrictions, orders, or actions; acts of war or terrorism; civil unrest; labor disputes or strikes; mechanical or technical failures of vessels or equipment not attributable to Pangaea Exploration LLC negligence; or port closures (each, a “Force Majeure Event”). This clause governs our general liability for events outside our control and operates alongside, but separately from, the Unavoidable & Extraordinary Circumstances clause above, which sets out specific cancellation and refund rights triggered by such events.
In the event of a Force Majeure Event, no refunds or credits will be automatically issued; however, Pangaea Exploration LLC will make reasonable commercial efforts to reschedule or rebook your voyage on a mutually agreeable date, subject to availability. Nothing in this clause limits any rights you may have under applicable Florida law that cannot be excluded or waived by contract.
Prompt Assistance
If, while you are on the trip, you find yourself in difficulty for any reason, we will offer such assistance as is reasonably able and appropriate in the circumstances. We will provide you with appropriate information on health services and local authorities, and assistance with communications and finding alternative travel arrangements. Pangaea Exploration LLC will not be liable for any associated costs for assistance provided or alternative arrangements made in such circumstances.
Mandatory Travel Insurance
Adequate travel insurance is a mandatory condition of your contract with Pangaea Exploration LLC. No booking will be accepted, and no participation will be permitted, without a valid policy in place. You must obtain and maintain your insurance policy before submitting your booking deposit. This is not a recommendation — it is a contractual requirement.
Required coverage
• Offshore sailing and related adventure activities;
• Medical care, emergency evacuation, and repatriation;
• Trip cancellation, interruption, and delays;
• Loss of or damage to personal possessions; and
• Pre-existing medical conditions.
Activity-specific coverage
Your policy must also cover the specific activities included in your Panexplore voyage. These include, but are not limited to:
• Sailing outside territorial waters (more than 12 nautical miles offshore);
• Snorkelling, swimming, kayaking, stand-up paddleboarding, and other water-based activities;
• Riding in tenders to/from the shore or yacht;
• Hiking and walking at your trip location.

Proof of insurance
You may be required to produce a valid certificate of insurance prior to boarding. Failure to produce proof when requested, or arriving without a valid policy in place, will result in you being denied participation. In that event, the cancellation terms and loss of payments will apply and no refund will be due.
Pangaea Exploration LLC’s exclusion of liability
Pangaea Exploration LLC accepts no liability for any medical expenses, emergency evacuation costs, repatriation costs, or any other loss or expense incurred by Crew that would ordinarily be covered by adequate travel insurance. No coverage will be provided by Pangaea Exploration LLC for claims arising from communicable disease exposure or related disruptions. All such claims must be directed to your own travel insurer. Your failure to obtain or maintain adequate insurance does not transfer any liability to Pangaea Exploration LLC.
Fitness to Travel, Disabilities & Medical Conditions
Our trips require a level of physical fitness and health sufficient to ensure the safety and security of everyone involved. If you have any concerns about your health, medical conditions, or a disability impacting your ability to participate, please contact us before booking so that we can advise on the suitability of your chosen trip. Where we are not able to accommodate your needs, we will not confirm your booking.
You must complete Pangaea Exploration LLC’s medical screening process and submit your Medical Form, signed by your licensed medical practitioner, no later than 90 days before the trip start date. If you do not complete your medical screening by the required date, you will be deemed to have cancelled and the cancellation terms and loss of payments will apply.
If a new medical condition arises after booking, or if there are any changes to an existing medical condition, it is your responsibility to inform us as soon as possible. You may be required to complete a further medical screening. If you fail the additional screening, you will be deemed to have cancelled and the cancellation terms and loss of payments will apply. All claims in such circumstances must be directed to your travel insurer.
We will ask you to disclose medical information. It is important that any information you provide is complete and accurate. Failure to provide full details in your medical screening, or omission of material information, will subject you to the cancellation terms. In the situation where you are unfit to travel, likely to endanger the safety of the professional team or other Crew, or likely to be refused permission to enter a trip destination, you will not be permitted to take part. Pangaea Exploration LLC reserves the right to refuse permission to join the trip or to require you to leave at any time on these grounds.
We will do our utmost to cater for any essential additional requirements you may have, such as a dietary requirement or allergy. Due to the nature of our trips, we cannot usually accommodate non-essential requests, but please contact us for further information.
By making a booking, you confirm that you are physically and mentally fit to participate in a demanding offshore sailing voyage. You agree to disclose any relevant medical conditions, allergies, or physical limitations prior to departure. Pangaea Exploration LLC reserves the right to deny boarding or remove any participant who, in its reasonable judgment, poses a safety risk to themselves or others. This right is exercised in the interests of crew safety and does not give rise to any claim for refund or compensation beyond the terms expressly set out in this Agreement.
Entry, Passport, Visa & Immigration Requirements; Safety & Health Formalities
It is your sole responsibility to check and fulfill all entry, passport, visa, immigration, and health formalities (including vaccinations) applicable to the countries you are visiting and transiting through. Requirements vary by nationality and are subject to change; we can only provide general information. You must verify requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own physician. Most countries require passports to be valid for at least six (6) months after your return date. If your passport is in its final year of validity, you should check with the Embassy of the country you are visiting before travel.
Pangaea Exploration LLC does not accept any responsibility if you are unable to travel, or incur any other loss, because you have not complied with any entry, passport, visa, immigration, or health requirements. You agree to reimburse Pangaea Exploration LLC in relation to any fines or other losses Pangaea Exploration LLC incurs because of your failure to comply with any such requirements.
Late Arrival or Cutting Your Trip Short
If you do not arrive, or arrive late to the start point and have missed the mandatory safety briefings for the trip, it will be at the sole discretion of the Skipper or Company whether you may join the trip. If participation is not possible in these circumstances, your booking will be terminated and the cancellation terms and loss of payments will apply.
If you return home early, we cannot refund the cost of any travel arrangements you have not used. If you cut short your trip and return home early, we will not offer any refund for the unused portion of your trip, nor will we be liable for any associated costs you may incur. Depending on the circumstances, your travel insurance may offer coverage for curtailment, and we suggest that any such claim is made directly with your insurer.
Your Behavior
All participants are expected to conduct themselves appropriately at all times. Life aboard is communal and requires flexibility, patience, and cooperation. Privacy is limited. All Crew are expected to contribute to a respectful and positive onboard culture and to follow the direction of the vessel’s leadership at all times. Pangaea Exploration LLC reserves the right to terminate a booking with immediate effect where conduct falls below the required standard.
You must, in the view of the Skipper, Mate, or any other person of authority onboard:
- Be an active and willing participant, contributing to the delivery of the trip and program, including but not limited to: standing watch (including overnight shifts), hoisting, trimming, and reefing sails, navigating and helming when assigned, participating in meal preparation and galley duties, cleaning and maintaining common areas and personal quarters, assisting with docking, anchoring, and sail handling operations, practicing mutual respect and inclusion toward fellow Crew regardless of gender, race, religion, or experience.
- Comply with all reasonable requests made by the Pangaea Exploration LLC Skipper, professional team or any person of authority, and comply at all times with all regulations and notices relating to safety. You must not engage in risky behavior that impacts the safety of yourself or others. The Skipper retains full authority to deny participation in any activity or to remove a Crew member if their behavior or condition compromises safety. Crew agree to follow all emergency procedures, use provided safety equipment (PFDs, tethers, harnesses) as instructed, and exercise personal responsibility for their safety and the safety of others on board.
- Take responsibility for managing your own physical well-being, including staying hydrated, well-fed, and rested; wearing appropriate clothing for changing weather conditions; securing adequate sleep during off-watch periods; and bringing proper personal gear (wet weather gear, layers, non-marking shoes, etc.)
- Take reasonable care of all equipment and machinery; not cause damage to property; not cause a delay or diversion to the trip itinerary or program.
- Not cause distress, disruption, or annoyance to other participants or any third party, and not engage in or display any of the following: bullying or threatening behavior; homophobia or transphobia; racism; libel or slander; behavior that is incompatible with our inclusive, positive ethos; or any other negative behavior. This applies both in person and online.
- Not smoke, vape, or consume alcohol during the trip without permission from Pangaea Exploration LLC Skipper or professional team.
- Not bring onto the trip any restricted or illegal goods including drugs, firearms, weapons, explosives, or any articles of a flammable or dangerous nature. You shall be liable for any injury, loss, damage, or expense arising from a breach of this term, and may also be liable for statutory fines and/or penalties. You must not do or omit to do any action or thing whereby Pangaea Exploration LLC may become liable to arrest or detainment or cause the arrest or detainment of other participants.
In the event of termination for breach of behavior standards, Pangaea Exploration LLC’s liability to you will cease immediately and you will be required to leave the trip. No refunds will be made and Pangaea Exploration LLC will not pay any expenses or costs incurred as a result of termination. You shall be liable for any death, injury, damage, or expense arising from a breach of any term of this condition, and may be liable for statutory fines and/or penalties. Full payment for any damage or losses caused by your actions must be made prior to your departure from the trip. Pangaea Exploration LLC cannot be held responsible for the actions or behavior of other participants or individuals who have no connection with your trip.
Pangaea Exploration LLC’s Obligations
Pangaea Exploration LLC shall ensure the Yacht is seaworthy and compliant with applicable safety regulations (including, as applicable, the MCA Small Commercial Vessel Code). Pangaea Exploration LLC will provide a qualified professional Skipper and Mate for the duration of the voyage. Pangaea Exploration LLC retains the right to change the itinerary, port of embarkation or disembarkation, or course due to weather, safety, or other operational needs. The Skipper has final authority regarding safety, navigation, and the conduct of all Crew members.
Insurance & Liability
Pangaea Exploration LLC’s insurance
Pangaea Exploration LLC shall ensure that the Yacht and her equipment are at all times insured for their full replacement value, with third-party liability cover of no less than USD 2,000,000 per occurrence. Crew shall do nothing that may invalidate the Yacht’s insurance or prejudice Pangaea Exploration LLC’s right to claim thereunder. Any act or omission by a Crew member that causes or contributes to the invalidation of such insurance shall render that Crew member personally liable for any resulting loss or damage.
Important: Pangaea’s insurance does not cover paying Crew participants
Pangaea Exploration LLC’s vessel insurance and crew insurance policies are maintained for the benefit of the Yacht and Pangaea’s employed professional crew respectively. Neither policy extends to cover paying Crew participants. The vessel’s third-party liability policy expressly excludes liability to paid crew. Paying Crew participants are not insured persons under any Pangaea Exploration LLC insurance policy and have no entitlement to make claims under those policies. You are solely and entirely reliant on your own personal travel insurance for any claim arising from personal accident, medical treatment, evacuation, repatriation, trip cancellation, or any other loss or expense connected with your voyage. This reinforces the mandatory insurance requirement set out in Condition 1 of these Terms and Conditions.
Navigation limits and insurance coverage
The Yacht’s insurance is subject to defined navigation limits. Certain geographical areas are excluded from coverage under the vessel policy, including areas designated from time to time by the Joint War Committee (JWC) as Listed Areas. Pangaea Exploration LLC reserves the right to decline, modify, or cancel any voyage if proceeding would place the Yacht outside its insured navigation limits. In such circumstances, the provisions of the Unavoidable and Extraordinary Circumstances and Company Cancellation Policy clauses of these Terms and Conditions will apply as appropriate. No liability will attach to Pangaea Exploration LLC for losses arising from a voyage being declined or modified on this basis.
Pangaea Exploration LLC’s liability to Crew
Pangaea Exploration LLC and/or its Skipper shall have no liability for death or personal injury suffered by Crew, save where caused directly by Pangaea Exploration LLC’s negligence or willful misconduct. To the fullest extent permitted by applicable Florida law, Pangaea Exploration LLC shall have no liability to Crew in respect of any consequential loss, economic loss, loss of profit, loss of use, or loss of enjoyment arising in connection with a voyage, howsoever caused. For the avoidance of doubt, the Yacht’s third-party liability insurance expressly excludes claims brought by or on behalf of paid Crew participants. Any claim by a paying Crew member for personal injury, illness, or death must be pursued through that Crew member’s own personal travel insurance. Pangaea Exploration LLC’s liability to any individual Crew member, where liability is established, shall not in any event exceed the total amount paid by that Crew member directly to Pangaea Exploration LLC for the voyage in question.
Damage to the Yacht
In the event of major damage to the Yacht during the voyage period involving a claim on the Yacht’s insurance, or in the event of a breakdown of machinery or equipment rendering the Yacht unseaworthy or unusable for more than 36 consecutive hours, a pro rata refund will be made for the period during which the Yacht was unseaworthy or unusable, provided that: (a) the Crew has not caused or contributed to the damage or breakdown; and (b) Pangaea Exploration LLC shall not be liable for any other compensation arising out of such damage or breakdown, whether consequential, financial, or otherwise. Nothing in this clause shall limit or exclude any claim arising out of death or personal injury resulting from negligence on the part of Pangaea Exploration LLC.
Personal property
Crew are solely responsible for all personal property while on board the Yacht. Any personal property left on board upon completion of the voyage will not be Pangaea Exploration LLC’s responsibility. If found, the cost of returning such property will be borne entirely by the Crew member. Pangaea Exploration LLC accepts no liability for loss of or damage to personal belongings, howsoever caused.
Communicable disease exclusion
Pangaea Exploration LLC and its insurers shall have no liability for any loss, damage, liability, claim, cost, or expense of whatsoever nature caused by, contributed to by, resulting from, arising out of, or in connection with a Communicable Disease, or the fear or threat (whether actual or perceived) of a Communicable Disease, regardless of any other cause or event contributing concurrently or in any other sequence thereto. This exclusion applies whether or not the Communicable Disease was the proximate cause of the loss. “Communicable Disease” means any disease which can be transmitted by means of any substance or agent from any organism to another organism, where the substance or agent includes but is not limited to a virus, bacterium, parasite or other organism or any variation thereof (whether deemed living or not), and the method of transmission, whether direct or indirect, includes but is not limited to airborne transmission, bodily fluid transmission, transmission from or to any surface or object, solid, liquid or gas or between organisms. All claims arising from or connected with a Communicable Disease must be directed to your own personal travel insurer.
Complaints
We make every effort to ensure that the trip runs smoothly. If you have a problem during the trip, please inform the Skipper immediately so that they may endeavour to resolve it. If the problem cannot be resolved locally and you wish to complain further, please contact hello@panexplore.com. You must send formal written notice of your complaint to us by email within 14 days of the end of your trip, including the trip name and all relevant information. Please keep your communication concise and to the point to assist us in identifying your concerns and responding promptly. Failure to follow this procedure may affect Pangaea Exploration LLC’s ability to investigate your complaint and may affect your rights under this contract.
Photography & Media Release
By participating in a Panexplore voyage, you grant Pangaea Exploration LLC a royalty-free, perpetual, worldwide license to use photographs, video, and audio recordings in which you appear, taken during the voyage, for marketing, promotional, and educational purposes, including on the Pangaea Exploration LLC’s website and social media channels. No compensation will be payable to you in connection with any such use. If you do not wish to be photographed or recorded, you must notify us in writing prior to the commencement of your trip. Notification after embarkation will not be effective with respect to media already captured. This release is made voluntarily and with full understanding of its terms.
Intellectual Property Rights
Our content and brand
The Site and all content published on it — including text, photography, video, graphics, voyage descriptions, logos, and the Panexplore and Pangaea Exploration LLC trade names and marks — are owned by or licensed to Pangaea Exploration LLC and are protected by applicable copyright, trademark, and other intellectual property laws. You may view and download content from the Site for your own personal, non-commercial reference only. You may not reproduce, republish, redistribute, or commercially exploit any content from the Site without our prior written consent.
Content you share with us
From time to time, Crew members share photographs, videos, written accounts, or other content relating to their voyage with us, whether by submitting directly to us, tagging us on social media, or sending material via email or messaging platforms. Where you share such content with us, you grant Pangaea Exploration LLC a royalty-free, non-exclusive, worldwide license to use, reproduce, and display that content for the purposes of promoting our voyages and services, including on our website, social media channels, and in marketing materials. You confirm that you own or have the right to share any content you submit, and that its use by us will not infringe any third party’s rights. We will not sell your content to third parties.
Feedback and suggestions
If you provide us with feedback, ideas, or suggestions about our voyages or services, we may use these freely to improve our offerings without any obligation to you.
Limitations on Linking and Framing
You may establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your site by us or by the Site. However, you may not, without our prior written permission, frame or inline link any of the content of the Site, or incorporate into another website or other service any of our material, content, or intellectual property.
Digital Millennium Copyright Act (DMCA)
If you believe any content published on our Site infringes your copyright, please contact us at hello@panexplore.com with details of the material concerned. We will review all notices promptly and take appropriate action where infringement is established.
Privacy & Data Protection
Data controller
The data controller responsible for your personal information is Pangaea Exploration LLC, trading as Panexplore, a Florida limited liability company with its principal place of business in Miami, Florida, USA. For all data-related enquiries, please contact us at hello@panexplore.com. A full description of our data practices is set out in our Privacy Policy, available at www.panexplore.com, which is incorporated into these Terms & Conditions by reference. By using our Site or making a booking, you confirm that you have read and understood the Privacy Policy.
What data we collect and why
We collect and process personal data for the following purposes, each supported by a lawful basis: (a) processing your booking and delivering your voyage — on the basis of contractual necessity; (b) complying with legal and regulatory obligations — on the basis of legal obligation; (c) communicating with you about your booking and our services — on the basis of contractual necessity and legitimate interests; (d) sending marketing communications — on the basis of your prior consent, which you may withdraw at any time; (e) health, safety, and medical screening — on the basis of explicit consent and, where applicable, vital interests or substantial public interest; and (f) improving our services and operating our Site — on the basis of legitimate interests. We will not use your data for any purpose incompatible with those for which it was collected without first obtaining your consent.
Health and medical data
As part of our medical screening process, we collect and process health and medical information. This constitutes “special category” personal data under GDPR and “sensitive personal information” under the Florida Digital Bill of Rights. We are not a HIPAA-covered entity; however, we handle all health data with the same standard of care and confidentiality. We process this data solely on the basis of your explicit consent, given at the time of completing your Medical Form, and to the extent necessary to ensure the safety of you and all Crew. You may withdraw this consent at any time by contacting us in writing; however, withdrawal may prevent us from confirming or maintaining your booking.
Data retention and sharing
We retain personal data only for as long as is necessary for the purposes for which it was collected, and in any event no longer than required by applicable law. Booking and transactional records are retained for a minimum of seven years to satisfy financial and legal obligations. Health and medical data is deleted within 12 months of the conclusion of your voyage unless retention is required by law. We may share your data with trusted third-party processors acting on our behalf — including payment processors, medical screening providers, and delivery partners — all of whom are bound by appropriate data protection agreements. We share data with regulatory or legal authorities only where required by law. We do not sell your personal data.
Your rights
Depending on your jurisdiction, you may have the following rights in relation to your personal data: the right to access a copy of your data; the right to correct inaccurate data; the right to erasure (“the right to be forgotten”); the right to restrict or object to processing; the right to data portability; and the right to withdraw consent at any time without affecting the lawfulness of prior processing. Florida residents have additional rights under the Florida Digital Bill of Rights (FDBR), including the right to opt out of the sale of personal data and its use for targeted advertising, and the right to non-discrimination for exercising these rights. We will acknowledge your request within five business days and respond in full within the timeframes required by applicable law. International data transfers
As an internationally operating company, we may transfer your personal data to the United States and to other countries in which our service providers operate. Where we transfer data from the European Economic Area (EEA) or the United Kingdom, we rely on appropriate safeguards to ensure that your data receives an equivalent level of protection, including the use of EU Standard Contractual Clauses (SCCs) or the UK International Data Transfer Agreement (IDTA), as applicable. Details of the transfer mechanisms we use are set out in our Privacy Policy. By submitting your data through our Site or booking process, you acknowledge that your information may be transferred and processed outside your country of residence.
SMS Opt-In Agreement
By providing your phone number on our Site, you consent to receiving text messages, including promotional content, from Pangaea Exploration LLC, trading as Panexplore. Message frequency will vary. Standard messaging and data rates may apply. You may opt out at any time by replying with the word “STOP.” Upon opting out, you will receive one final message confirming your removal from the text messaging program.

Carriers are not liable for delayed or undelivered messages. Your information will not be shared with third parties for their own marketing purposes, except as described in our Privacy Policy.
Marketing & Newsletter Communications
By subscribing to our newsletter or marketing communications through the Site or otherwise, you consent to receiving periodic emails from Pangaea Exploration LLC containing trip announcements, promotional offers, voyage updates, and other content related to our services. We will only send marketing emails to individuals who have expressly opted in to receive them.
You may unsubscribe from our marketing emails at any time by: (a) clicking the “unsubscribe” link included at the bottom of every marketing email we send; or (b) emailing us directly at hello@panexplore.com with the word “STOP” or “UNSUBSCRIBE” in the subject line. We will process your opt-out promptly and within the timeframes required by applicable law. Please note that even after unsubscribing from marketing communications, you may continue to receive transactional or service-related emails necessary for the administration of your booking or account.
Our marketing communications comply with the CAN-SPAM Act of 2003 and applicable Florida law. Each marketing email we send will clearly identify Pangaea Exploration LLC as the sender, include our physical mailing address, and provide a clear and functioning mechanism to opt out of future communications. Accuracy of Information
We endeavor to ensure that all information and prices on our website and in our marketing materials are accurate; however, errors and changes may occasionally occur. Pangaea Exploration LLC reserves the right to correct prices and other details at any time. It is your responsibility to verify the current price and all other details relating to the arrangements you wish to book before completing your booking. Nothing in this clause limits any rights you may have under applicable Florida law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PANGAEA EXPLORATION LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND DELIVERY PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR BOOKING, YOUR VOYAGE, OR YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF ENJOYMENT, LOSS OF PROFIT, LOSS OF USE, OR ANY OTHER ECONOMIC LOSS. WHERE PANGAEA EXPLORATION LLC IS FOUND TO BE LIABLE, OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU DIRECTLY TO PANGAEA EXPLORATION LLC FOR THE VOYAGE IN QUESTION. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU IN FULL; IN SUCH STATES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS & CONDITIONS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.
Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to this Agreement, your use of the Site, or your participation in any Pangaea Exploration LLC expedition or voyage — including questions about the existence, validity, or termination of this Agreement — shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as amended from time to time. The arbitration shall be conducted in Miami-Dade County, Florida, or, at your election, by telephone or videoconference. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small Claims Exception. Notwithstanding the foregoing, either party may elect to bring an individual claim in a Florida small claims court for disputes that fall within that court’s jurisdiction (currently claims of $8,000 or less). This small claims exception does not apply to any claim seeking injunctive or declaratory relief, or to any claim that is part of a class or representative action.
Class Action Waiver. YOU AND PANGAEA EXPLORATION LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If a court or arbitrator determines that this class action waiver is unenforceable with respect to any claim, then the arbitration agreement shall not apply to that claim, and that claim shall be brought exclusively in the state or federal courts of Miami-Dade County, Florida.
Injunctive Relief. Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the resolution of a dispute by arbitration, including to protect intellectual property rights.
This Agreement shall be binding upon and inure to the benefit of Pangaea Exploration LLC and our respective assigns, successors, heirs, and legal representatives. Neither this Agreement nor any rights hereunder may be assigned by you without the prior written consent of Pangaea Exploration LLC. Notwithstanding the foregoing, all rights and obligations under this Agreement may be freely assigned by Pangaea Exploration LLC to any affiliated entity or any of its wholly owned subsidiaries.
Severability
If any provision of this Agreement is found by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions, which shall continue in full force and effect.
Changes to these Terms & Conditions
We reserve the right to update or amend these Terms and Conditions at any time. Where changes are material, we will provide reasonable notice by posting the updated Terms on our website and, where practicable, by notifying you directly. The updated Terms will take effect from the date of posting unless a later effective date is stated. Your continued use of the Site or participation in a Pangaea Exploration LLC voyage following any such update constitutes your acceptance of the revised Terms.
